T&CS of Purchasing a Castlemains Horse

1.    Purchaser will pay a deposit of 10% of horses sale price within 24 hours of agreeing to purchase the horse. Please note the horse is still available for sale until deposit is paid to seller. Deposit is only refundable if horse fails the vetting (excluding any predisclosed issues) at which point seller or buyer reserves the right to cancel the sale. Full payment must be made within 7 days of deposit payment unless otherwise agreed.
2.    Purchaser reserves the right to have the horse vetted onsite at Castlemains Equestrian should they wish and are responsible for organising and paying all costs associated with having the vetting done. Vettings are to be carried out within 7 days of deposit payment unless otherwise agreed upon.
3.    Transport should be arranged within 14 days of deposit payment and purchaser is responsible for arranging and paying all costs associated with transporting the horse. Horses not collected within 14 days can be kept onsite at the going full livery rate.
4.    Seller can not be held responsible for horses passing strangles testing, in the unlikely event it requires further investigation or treatment new owner is responsible for all costs associated with this. It is recommended that horses are quarantined and tested upon arrival at new home as per industry standard.
5.    No horse is sold with tack, it is up to you as the purchaser to ensure you have suitably fitting tack that is fit for purpose after purchase. 
6.    All horses are sold with 14 day warranty whereby should they not be fit for purpose they can be returned to the seller and a refund given or exchanged for another horse. Where there is not another horse suitable a refund will be given. Horses sold as seen or project horses are not sold with warranty and no warranty is given or implied in this instance. Warranty period starts from date full payment is received which is to be at latest 7 days from deposit payment. The following terms apply to qualify for a refund or exchange;
a.    The purchaser will have allowed the horse time to settle into its new home, it is understood that horses are live animals and therefore can take time to adjust to new settings. 
b.    The purchaser will keep the horse in a similar nature to how it was kept while with the seller – i.e. purchaser will make every attempt to keep feed, routine, grazing, workload etc the same during the warranty period and ensure the horse has adequately fitting tack that is fit for purpose to give the horse the best chance at settling in new home. Seller cannot be held liable in any way for changes to management altering horses behaviour in new home. Purchaser is responsible for ensuring they have adequate knowledge, conditions and support in place to keep a horse.
c.    If horse is to be exchanged or returned it must be returned to seller in same condition it was sold in with no blemishes, injuries, defects or illness that it was not sold with. Seller reserves the right to have the horse vet checked upon its return and any costs associated with blemishes, injuries, defects or illness will be deducted from the refund.
d.    If horse is to be returned or exchanged purchaser is responsible for arranging transport and all costs associated with this.
